PLEASE NOTE: All bidders acknowledge that they have read these terms and conditions of sale and agree to be bound thereby. If you do not understand any of these terms or conditions, please ask us for clarification before registering.
1. Identification - All bidders must be 18 years of age and are required to have a Bidder’s Number to bid and shall supply Consignment Connection LLC with their full name, address and telephone number. A form of picture identification is required when asked to verify information.
2. Addition to or withdrawal from sale - Consignment Connection LLC reserves the right to withdraw from sale any of the items listed or to sell at this auction items not listed, and also reserves the right to group one or more lots into one or more selling lots or to subdivide into two or more selling lots. Whenever the best interest of the seller will be served, the auction company reserves the right to sell all of the items listed in bulk. Consignment Connection LLC may place reserves on items per Indiana law. Reserves may or may not be listed on website.
3. The auctioneer has the right at his absolute discretion to refuse any bid. The highest bidder shall be the buyer at the sold price plus any buyer's premium, states sales tax, and or shipping costs. Failure to pay for or collect items will result in revoked bidding privileges. Repeated noncompliance will result in permanent suspension. The bidder that has not paid for or has not removed their items from the auction site within allotted time, will be subject to the cost of if any; storage, trucking, re-sale, deficiency balances, collection fees, and any legal fees for recouping a loss due to the bidder's negligence.
4. Dispute between bidders - If any dispute arises between two or more bidders, the auctioneer may decide the same or may immediately put the lot up for sale again and resell to the highest bidder. The decision of the auctioneer shall be final and absolute.
5. Condition of items sold - The auctioneer shall not be responsible for the correct description, authenticity, genuineness of, estimated selling price of, or defect in any lot, and makes no warranty in connection therewith. No allowance will be made or sale set aside on account of any incorrectness, error in cataloging, or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold “as is” and without recourse. Everything is sold “AS IS/WHERE IS” with no warranties, representation or guarantees expressed, implied or otherwise given. All sales are final.
6. PAYMENT TERMS - The buyer specifically waves the right to dispute or deny payment for any purchases made with a credit card. Buyer's paying by credit card will need to pay invoices through our website for all purchases, including any applicable fees incurred such as buyer's premium, sales tax, shipping related costs, late fees, removal fees, or any other fees that may have been incurred due to buyers' negligence. immediately following the auction. Denied cards (NSF, expired, etc.) may incur a $10 reprocessing fee.
Any invoice total exceeding $500 or titled vehicles MUST be paid via cash, wire transfer, or prior arrangements with Consignment Connection LLC. All payments are final. NO REFUNDS ALLOWED. No item will be released or transferred until payment has been posted to our account.
All lots are to be paid in full by cash, approved check, MasterCard, Visa, or Debit Card within 72 the close of the auction. Consignment Connection reserves the right to hold merchandise until a buyer’s check clears. Consignment Connection also reserves the right to not accept a check. There will be a $35.00 service charge for any check returned from the bank for any reason.
7. All measurements and sizes - are approximate. No guarantees are provided on measurements, sizes, the condition, or accuracy of descriptions of items. All goods are sold AS-IS. Everything is sold “AS IS/WHERE IS” with no warranties, representation or guarantees expressed, implied or otherwise given. All sales are final. If you are unsure of items description, preview items in advance and make your own assessments. In default of payment of items within the time announced for any given auction, the Auction Company, in addition to all other remedies allowed by law, may retain all monies received as deposit or otherwise, as liquidated damages.
If an item cannot be provided due to theft, acts of God, war, or any other reason, the buyer will be entitled to compensation equal to the money paid for the item and no more.
8. Minimum bids - may be placed on some items.
9. Pick Up & Removal - All items must be picked up from the given auction location for that auction and shall be at the expense, liability, and risk of the purchaser. Any items not picked up by the end of the last pick-up day for that auction, items shall revert back to seller with no refund to buyer. Purchases can be delivered or shipped for a fee and only on presentation of paid bill. Payment terms for Items, Shipping and or delivery of items must be met during given time period for that auction, or items will be considered forfeited without refund. Consignment Connection shall not be responsible for goods not removed within the time specified and shall have the option of removing and storing or reselling at the expense and risk of the purchaser any article purchased. Allotted removal period is on a per auction basis unless prior approval has been made. LOTS MAY NOT BE TAKEN FROM Consignment Connection LLC UNTIL CHECKED OUT BY AUCTION STAFF.
10. Claims - No claims will be allowed.
11. Personal and property risk - Persons attending during exhibition, sale or removal of goods assume all risks of damage of or loss to person and property and specifically release Consignment Connection LLC, Auctioneers, and Consignors from liability, therefore. Neither the auctioneer nor his principal shall be liable by reason of any defect in or condition of the premises on which the sale is held.
12. Records - The record of sale kept by the auctioneer and clerk will be taken as final in the event of any dispute.
13. All lots - to be sold AS IS, WHERE IS. ALL SALES FINAL.
14. This sale is being conducted pursuant to Section 2328 of the Uniform Commercial Code and Section 53.5 of the Penal Code.
15. Additional terms and conditions - Any additional terms or conditions of sale, added by auctioneer, shall be take precedence over any prior terms and conditions. Ant additional terms and conditions will be announced prior to auction.
